A judge in the United States ruled on Wednesday that Amazon's collection of billing information from subscription users before disclosing the terms of the Prime membership service violated the Consumer Protection Act. This ruling gave the Federal Trade Commission (FTC) a partial victory. The case accuses Amazon of using deceptive means to attract users to register for Prime membership. Judge John Chun's ruling puts Amazon at a disadvantage in the upcoming trial. The FTC is prepared to argue in court that the online retailer automatically enrolled millions of users in Prime membership without their consent and obstructed millions of users from canceling their memberships through a complex cancellation process. The agency stated that these actions violated the Restore Online Shoppers Confidence Act (ROSCA). The judge also ruled that if the FTC proves Amazon engaged in illegal behavior in court, two Amazon executives will be held responsible, and Amazon is prohibited from claiming that ROSCA does not apply to Prime membership registrations.
