The Colorado Supreme Court on Monday rejected efforts by Exxon Mobil and Suncor Energy to dismiss a lawsuit brought by the city of Boulder holding these two fossil fuel companies accountable for climate change. In a 5-2 ruling, the Colorado Supreme Court stated that federal law does not prevent Boulder and surrounding counties from accusing these two energy companies of misleading the public on the dangers of fossil fuels, thereby violating state law. This ruling marks the second time in several years that the state's highest court has allowed state and local governments to sue large energy companies on climate change issues. The Hawaii Supreme Court allowed similar lawsuits against Exxon, Sunoco, and several other companies to continue, and the US Supreme Court refused to review the judgment in January of this year. Boulder filed the lawsuit in 2018, alleging that these companies violated multiple state laws and caused public and private harm by misleading the public about the role of their fossil fuel products in exacerbating climate change.
