The second review of the draft amendment to the Trademark Law will increase the efforts to crack down on the use of registered trademarks in a way that misleads the public.
The second draft amendment of the Trademark Law will be submitted for deliberation at the 23rd meeting of the 14th National People's Congress Standing Committee. Huang Haihua, spokesperson of the Legislative Affairs Commission of the NPC Standing Committee, stated at a press conference that based on various opinions, the second draft amendment proposed the following main modifications: First, to strengthen the purpose of "regulating the registration and use of trademarks"; Second, to enhance the management of trademark use in the internet environment; Third, to stipulate that the State Administration for Industry and Commerce should establish a unified trademark registration application service platform to facilitate the query, registration, and use of trademarks; Fourth, to make connecting provisions for the registration and use of national park logos, Olympic logos, etc. as trademarks; Fifth, to increase efforts in cracking down on the use of registered trademarks in a misleading manner; Sixth, to strengthen the supervision and management of trademark agencies and practitioners; Seventh, to improve provisions related to handling overseas trademark infringement cases and strengthen the protection of the overseas rights and interests of Chinese enterprises; Eighth, to further promote the resolution of the issue of excessive registration and insufficient use of trademarks.
