National Intellectual Property Administration: Strengthen trademark usage management, focusing on seven types of illegal and irregular behaviors.
The State Intellectual Property Office issued a notice to strengthen the management of trademark use, clarify the key focus of illegal activities, and strictly regulate deceptive practices such as false descriptions through trademarks to mislead the public. Key illegal activities of concern include: 1. Using unregistered trademarks with deceptive content. Focus on unregistered trademarks containing "exclusive," "special," "premium," "national," etc., which lead to public misconceptions about the supply channels or quality of goods; using unregistered trademarks containing "rich selenium," "organic," "zero additives," "100%," etc., where the actual attributes of the goods do not match the content, leading to public misconceptions about the main ingredients, components, etc. of the goods; using unregistered trademarks containing place names, years, or "handmade," "handcrafted," etc., leading to public misconceptions about the origin, production time, production process, etc. of the goods. 2. Deceptively using registered trademarks. Focus on using registered trademarks in conjunction with product names, advertising slogans, packaging decoration, etc., leading to public misconceptions about the quality, origin, process, etc. of the goods; changing registration details to mislead the public about the quality of the goods, or changing details to associate with others' trademarks. 3. Using counterfeit registered trademarks. Focus on marking registered logos or indicating registered trademarks on deceptive unregistered trademarks. 4. Not using registered trademarks that should be used. Focus on the tobacco industry, especially new tobacco products such as electronic cigarettes. 5. Prominently using the term "well-known trademark" in commercial activities. Focus on using the term "well-known trademark" with recognized records in advertising. 6. Improper use of collective trademarks and certification trademarks. Focus on using collective trademarks and certification trademarks for goods that do not meet quality requirements. 7. Illegal representation by trademark agencies. Focus on trademark agencies and their employees representing malicious trademark registration applications, malicious "withdrawals of three," and other actions that harm the interests of trademark owners.
