The Supreme People's Procuratorate recently released a batch of typical cases of procuratorial public interest litigation. These typical cases include both administrative public interest litigation cases that urge administrative organs to perform their duties in accordance with the law and make up for shortcomings in supervision, as well as civil public interest litigation cases that pursue legal liability for infringement of public interests in accordance with the law. Among them, in the civil public interest litigation case involving the production and sale of toxic and harmful food handled by the procuratorial organs of Dongying City, Shandong Province, close attention was paid to the illegal addition of chemical active pharmaceutical ingredients to food. While pursuing criminal liability in accordance with the law, companies and sales agents not criminally prosecuted were included in the scope of accountability, and the co-infringers across the entire chain were asked to bear joint and several liability for punitive damages of ten times the amount, which received full support from the court, achieving comprehensive accountability through both criminal punishment and civil compensation. According to statistics, from January to August this year, procuratorial organs nationwide filed a total of 36 administrative public interest litigation cases and 952 civil public interest litigation cases in the field of food and drug safety, and proposed punitive damages in 776 cases.
