The "Key Points for the Development of the Digital Economy in 2026" issued by the National Bureau of Statistics proposes to promote the legislation process for digital economy promotion laws, continuously promote data security management, and strengthen the identification and protection of important and core data. With the rapid development of the data industry, the tension between the need for standardized data market order and insufficient data legislation has become increasingly prominent, which has hindered the development of the data industry. For example, due to unclear data ownership and usage boundaries, data practitioners generally face issues of "daring, unwilling, and unable" to develop and utilize data resources. Additionally, because it is difficult to confirm data rights, pricing, and circulation, many operating entities lack the enthusiasm to enter the data industry, making it difficult for the data market to form a concentration effect of funds and technology. In addition, in recent years, there have been more disputes concerning data rights, which further demonstrate that the development progress of China's basic rules for data protection lags far behind the progress of data utilization and development.
