In order to consolidate the results of the special action on standardizing administrative law enforcement involving enterprises, improve the long-term mechanism for standardizing law enforcement involving enterprises, and continue to alleviate the burden on enterprises, the Ministry of Justice, together with the Ministry of Ecology and Environment and the Ministry of Emergency Management, recently issued the "Opinions on Correctly Understanding and Applying the Law Enforcement Standards for 'Opening or Closing Windows for Production in Factories'", addressing the pressing issue of "opening or closing windows for production in factories" raised by enterprises. The aim is to guide the precise and standardized application of law enforcement standards at the grassroots level, promote law enforcement supervision that strictly adheres to safety and ecological bottom lines, and decisively eliminate mechanical law enforcement practices, in order to fully support high-quality economic and social development. Building on the experience from local practices, the "Opinions" formulate targeted strategies from multiple dimensions to resolve law enforcement challenges. First, focusing on the core requirements of "opening or closing windows", precise solutions are provided for regulatory challenges. The standards and exceptions are clearly defined. From an ecological and environmental protection perspective, measures such as using clean materials and locally collecting and treating exhaust gases can be taken in cases where complete closure or sealing is not possible, rather than mandating "always closing windows". From a safety production perspective, when hazardous materials exceed safety thresholds, ventilation measures such as interlocking fans need to be implemented, without requiring "keeping windows open at all times". Law enforcement officers are required to assess the situation on site and allow sufficient space for enterprises to operate. Second, establishing a sound joint law enforcement mechanism to address regulatory gaps. Strengthening enforcement procedures, local ecological environment and emergency management departments are required to strictly implement relevant provisions, establish a coordinated mechanism, develop joint inspection plans, conduct joint law enforcement, enhance collaborative governance, and promptly address inconsistencies in regulatory requirements through consultations. Third, strengthening coordinated guidance and services while considering safety and development. Efforts are made to improve the precision of law enforcement officers at the grassroots level and their ability to serve enterprises, urging local ecological environment and emergency management departments to coordinate the relationship between production operations, safety production, and environmental protection, enhance service awareness, guide enterprises to strictly adhere to laws and regulations, and scientifically standardize equipment and facilities to meet both environmental protection and safety requirements, effectively helping enterprises overcome dilemmas. The release of the "Opinions" this time is aimed at addressing the most concerning, direct, and practical issues for enterprises from a specific perspective. In the next step, the three departments will continue to monitor the implementation of the "Opinions", optimize and improve law enforcement standards and coordination mechanisms, strengthen the training of law enforcement personnel, and ensure the effectiveness of the "Opinions".
