Recently, the Guangzhou Intellectual Property Court ruled in the first instance that the "Shunfeng Suyun" car sticker constituted infringement on the well-known trademark "Shunfeng Suyun", and ordered the seller Shopxia'er Company to compensate Shenzhen Shunfeng Tyson Holdings Co., Ltd. 200,000 yuan, and publicly publish a notice in the newspaper to eliminate the impact. The court determined that the "Shunfeng Suyun" car sticker closely imitated the "Shunfeng Suyun" trademark, only changing the word "yun" to a homophone "yun", retaining the "SF" logo and "EXPRESS" in English, with a highly similar overall structure. This behavior not only weakens the distinctiveness of the well-known trademark, but also ridicules childbirth by using a homophone, damages the brand image, violates public order and good customs, and can easily lead the public to believe there is an association. The defendant argued that it was "online humor expression", but the court pointed out that such "meme marketing" has constituted "dilution infringement" prohibited by the Trademark Law.
