Issuance of the Implementation Measures for the Promotion of Private Economic Development through Intellectual Property Rights

The State Intellectual Property Office issued the "Implementation Measures for Promoting the Development of Private Economy through Intellectual Property Rights". The "measures" consist of 22 articles divided into eight chapters, mainly determining the following contents: In terms of intellectual property creation, it is explicitly encouraged and supported for private economic organizations to strengthen independent innovation, conduct forward-looking layout of intellectual property with high quality as the orientation, continuously improve the quality and efficiency of intellectual property examination, and actively serve the needs of various economic organizations including private economic organizations. In terms of intellectual property protection, it is explicitly stipulated to increase the protection of intellectual property rights for innovation achievements of private economic organizations and their operators, investigate and punish illegal acts infringing on trademark exclusive rights, patent rights, etc. in accordance with the law, leverage the role of national-level intellectual property protection centers to strengthen rapid coordinated protection of intellectual property rights, provide a one-stop solution for patent rapid preliminary examination, patent rapid confirmation, and dispute resolution for private economic organizations, expand diversified channels for resolving intellectual property disputes of private economic organizations, strengthen protection of foreign-related intellectual property rights, and enhance the ability to prevent and control risks in foreign-related intellectual property rights. In terms of intellectual property utilization, it is explicitly encouraged and supported for private economic organizations to adopt intellectual property transformation and utilization strategies that conform to their own characteristics and development needs, promote efficient transformation and utilization of intellectual property through self-implementation, equity participation, transfer, licensing, and pledge, encourage and support private economic organizations to explore new models of cooperation in intellectual property transformation and utilization such as establishing patent pools, patent open source, fully utilize open licensing methods to implement patents, establish industry intellectual property innovation alliances, and encourage and support private economic organizations to comprehensively utilize various types of intellectual property such as patents and trademarks. In terms of intellectual property public services, it is clearly stated to give full play to the advantage of intellectual property public service supply, precisely serve private economic organizations, improve the functions of intellectual property public service platforms, provide convenient services for private economic organizations through online one-stop services, and increase data openness and sharing for private economic organizations.
