On October 16, the Ministry of Commerce and the Ministry of Science and Technology issued an announcement to seek public comments on the revision of the Catalog of Technologies Prohibited or Restricted from Export in China and to implement temporary registration management for the export of related technologies. It was noted that this public consultation involves 40 technologies in three fields: artificial intelligence, biomedicine, and photovoltaics. In the field of artificial intelligence, there are 23 technologies related to large models, intelligent agents, computing power clusters, and information processing; technologies that have already entered the public domain through open-source release, publication of academic papers, and other means are not included in the scope of management. In the field of biomedicine, there are 5 technologies related to cell and gene therapy, small nucleic acid drugs, and pathogenic microorganisms; for outbound licensing models that do not involve transfer of ownership, facilitation measures such as automatic licensing apply. In the field of photovoltaics, there are 12 technologies related to polysilicon manufacturing, wafer manufacturing, and cell manufacturing; the scope of technology management also includes key and core equipment that carry the related technologies. The original text is as follows: Announcement No. 48 of 2026 by the Ministry of Commerce and the Ministry of Science and Technology: Public Consultation on the Revision of the Catalog of Technologies Prohibited or Restricted from Export in China and Implementation of Temporary Registration Management for the Export of Related Technologies In accordance with the Foreign Trade Law of the People's Republic of China and the Regulations of the People's Republic of China on the Administration of Import and Export of Technologies, the Ministry of Commerce and the Ministry of Science and Technology intend to revise the Catalog of Technologies Prohibited or Restricted from Export in China and add certain artificial intelligence, biomedicine, and photovoltaic technologies. Upon approval, public comments are now being solicited from society, and registration management before export is being implemented concurrently for the related technologies. I. Proposed Revision Content This public consultation involves 40 technologies in three fields: artificial intelligence, biomedicine, and photovoltaics. For the specific technical scope and policy explanations under consultation, see Attachment 1. II. Methods for Submitting Comments The public may, during the period from October 16, 2026 to November 15, 2026, submit comments through the following channels on the scope of newly added technologies, indicators, control policies, facilitation measures, and other matters: 1. Email: [email protected]; 2. Fax: 010-65197565; 3. Letter: Security and Control Bureau, Ministry of Commerce, No. 2 Dong Chang'an Avenue, Beijing, Postal Code: 100731. Please indicate "Public Consultation on the Catalog of Technologies Prohibited or Restricted from Export in China" in the subject line of the email, on the first page of the fax, and on the envelope. When submitting comments, please indicate the contact person, affiliated unit, and contact information. If comments are submitted in the name of a unit, the official seal of the unit shall be affixed. III. Pre-export Registration Requirements (1) From the date of publication of this announcement until the date when the revised Catalog of Technologies Prohibited or Restricted from Export in China is formally implemented, technology export operators shall, before exporting the technologies listed in the attachment to this announcement, register on the Technology Trade Management Information Application of the Ministry of Commerce Unified Business System Platform (https://ecomp.mofcom.gov.cn). Exports that have already begun but have not yet been completed are within the scope of registration. (2) Export situations requiring registration include: 1. Transfer of technology ownership to overseas parties, such as intellectual property transfer; 2. Licensing of domestic technology for use overseas, such as intellectual property licensing for use; 3. Change of the owner or actual controller of domestic technology to an overseas entity; 4. Other circumstances explicitly required by the Ministry of Commerce through notices or other means. (3) The information to be registered mainly includes: basic information of the technology export operator and the technology recipient, the destination country or region, the technology to be exported and its use, the estimated export amount of the technology, etc. (subject to the requirements of the Technology Trade Management Information Application of the Ministry of Commerce Unified Business System Platform, see Attachment 2 for details). If multiple technologies are to be exported to the same technology recipient in a single instance, they may be filled in together; in other circumstances, they shall in principle be filled in separately.
