The spokesperson for the Ministry of Justice answered questions from reporters regarding the inappropriate extraterritorial jurisdiction arising from the EU's investigation into foreign subsidies.
We hope that the European side will immediately correct its erroneous practices, stop the abuse of the "foreign subsidies" investigation tool, and create a fair, just, and predictable market environment for companies investing and operating in Europe. If the European side insists on going its own way, the Chinese side will firmly take countermeasures in accordance with the law.
On August 19, a spokesperson for the Ministry of Justice responded to media questions regarding the European Union's investigation into foreign subsidies and its improper extraterritorial jurisdiction. The spokesperson stated that recently, the EU, using its Foreign Subsidies Regulation, has conducted an investigation into JD.com, arbitrarily demanding extensive and unnecessary information from Chinese entities across borders, which constitutes improper requirements imposed on the relevant entities and represents a serious violation of international rule of law. To safeguard national sovereignty, security, and developmental interests, and to protect the legitimate rights and interests of Chinese citizens, legal persons, or other organizations, the Ministry of Justice, in conjunction with the Ministry of Commerce and other relevant departments, has identified and determined that the EU's aforementioned actions constitute improper extraterritorial jurisdiction measures. It requires that no organization or individual shall execute or assist in executing these measures. The Ministry hopes that the EU will immediately correct its erroneous practices and cease the abuse of the "foreign subsidy" investigation tool, thereby creating a fair, just, and predictable market environment for enterprises investing and operating in Europe. Should the EU continue to act obstinately, China will resolutely respond in accordance with the law.
